Licence agreement
The licence for the app obtained through the App Store is governed by Apple’s Standard Licensed Application End User License Agreement (EULA). WholePace does not use a custom EULA. The following terms supplement the Apple EULA with product-specific rules and do not replace it. In case of conflict, the Apple EULA prevails insofar as it concerns the licence to the app.
Availability
WholePace is intended to be available in the countries and regions Apple offers for distribution. Actual availability depends on the respective App Store approval.
Purpose of the app
WholePace helps you record foods, recipes and meals, follow nutritional values and daily targets and calculate guideline values for your energy needs. WholePace is intended for private, non-commercial use and for people aged 16 and over.
Health notice
WholePace is not a medical device and does not replace medical, therapeutic or nutritional advice. Nutritional values, energy needs, daily targets and the estimate of weight change are guideline values and may differ from your actual needs. If you have symptoms, a pre-existing condition, are pregnant, have an eating disorder or plan major changes to your diet, talk to a professional. The app is not intended for the detection, treatment or diagnosis of disease.
Local use
The app’s features can be used without an account. The content is then stored exclusively on the device concerned. You are responsible for protecting the device and for backing up the local content.
Account
- An account is optional. The information provided at registration must be accurate; by registering, you confirm that you are at least 16 years old.
- An account is personal. Sign-in details and unlocked devices must be protected against unauthorised access.
- You can delete your account at any time in the app under Settings. The consequences for your data are described in the Privacy Policy.
Content
The rights to content you record yourself, such as foods, recipes, meals and profile pictures, remain with you. Insofar as content is transmitted to our servers, you grant Xvision Solutions the non-exclusive right, limited to the duration of use, to store and transmit this content and to make it available to you.
You are responsible for the content you record in WholePace. It must not be unlawful or infringe the rights of third parties.
Permitted use
In particular, the following is not permitted:
- circumventing access or security mechanisms or attempting to access other accounts’ data
- automated or excessive use that impairs operation
- use for commercial or unlawful purposes
Costs and in-app purchases
The core features of WholePace are free of charge and contain no advertising. Optional extra features may be offered for a fee in the future.
Paid offers are processed exclusively through Apple In-App Purchase. Price, scope and, where applicable, term are shown in the app before purchase. Apple’s terms apply to purchase, billing, renewal, cancellation and refunds; subscriptions are managed and cancelled in the Apple Account settings.
Availability of the service
The local features work without an internet connection. Account and sign-in depend on an internet connection and on third-party services. We strive for reliable operation but cannot guarantee uninterrupted or error-free availability. Maintenance, security measures, technical faults or changes to third-party services may temporarily restrict features.
Liability
To the extent permitted by law, the liability of Xvision Solutions for slight negligence, indirect damage, consequential damage and loss of data is excluded. Liability for intent and gross negligence, for injury to life, body or health and under mandatory statutory provisions, in particular mandatory consumer protection law, remains unaffected. Where mandatory law provides for liability for a slightly negligent breach of essential contractual obligations, such liability is limited to the foreseeable damage typical for the contract.
To the extent permitted by law, we give no warranty for the accuracy of nutritional data that you record yourself or that is based on estimates, nor for decisions you make on the basis of the guideline values.
Changes to the app and these terms
WholePace is being developed further; features may change, be added or be removed. These terms may be updated if features, legal requirements or security requirements change. We will inform you of material changes in an appropriate manner, for example in the app.
Termination
You can end your use at any time by deleting your account and removing the app. In the event of serious or repeated breaches of these terms, we may restrict or terminate access to the account to the extent necessary.
Privacy
Information on the processing of personal data is provided in the Privacy Policy, available in the app and on wholepace.app.
Governing law and place of jurisdiction
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. To the extent permitted by law, the place of jurisdiction is the place of business of Xvision Solutions. Mandatory provisions protecting consumers, in particular regarding their place of jurisdiction and the law applicable in their country of residence, remain reserved.
